It was then left to the Home Secretary to rubber stamp the court’s ruling.

Hamza’s lawyer, Alun Jones QC, made a series of legal submissions to the Home Office in a bid to keep his client out of America.

But yesterday, three months after the ruling, the Home Secretary finally signed the papers for his extradition.

Birmingham Perry Barr MP Khalid Mahmood welcomed the Home Office’s move calling it “a victory for British Muslims”.

He said: “Those who propagate evil, hate and division cannot be a part of British society.” The Hamza extradition saga began on May 27, 2004, when he was arrested on an international warrant. 

But the process was interrupted five months later when Scotland Yard charged him with soliciting murder and incitement to racial hatred. 

The Old Bailey at that time heard how he poured out venom at meetings urging followers to kill non-Muslims. He branded Jews “filthy blasphemous traitors”. 

The cleric, who lost both hands and an eye in a minefield explosion in Afghanistan, also hated Muslims who disagreed with him. He had a terror manual at his home in Shepherds Bush, West London, listing plans to attack Big Ben, the Eiffel Tower, Statue of Liberty, football stadiums, airports and Christmas crowds. 

The key charges against Hamza in the US centre on the plot to kidnap Western hostages in the Yemen in December 1998. 

Four of the hostages, three Britons and an Australian, were killed when Yemeni troops stormed the militants’ hide-out.

Hamza is also accused of trying to set up an Al Qaeda training camp in Bly, Oregon, and being part of a global conspiracy to wage jihad on the West.

Last night Hamza’s lawyer, Muddassar Arani, said his client would be appealing the order.
